Terms & conditions
1. DEFINITIONS:
1.1 "Company" refers to Rowaale Water Technologies, the manufacturer and seller of the WaterPay Water ATM Pro Model.
1.2 "Customer" refers to the individual, business, or entity purchasing the WaterPay Pro Model from the company.
1.3 "Product" refers to the WaterPay Pro App-Based QR Water ATM Machine and its related products and services.
1.4 "Agreement" refers to these Terms and Conditions governing the sale, installation, service, and maintenance of the Product.
1.5 "WaterPay" is the trademark of the company and the brand name of vending machines.
3. DELIVERY & INSTALLATION:
3.1 Delivery timelines will be communicated to the Customer upon order confirmation and are subject to logistics constraints.
3.2 Any delays due to force majeure, transport strikes, or other uncontrollable circumstances do not make the Company liable for compensation.
3.3 The Customer is responsible for proper installation unless they have an option for training in Company-provided installation services.
3.4 The Company is not responsible for any damages due to incorrect installation or mishandling by the Customer.
3.5 The Company does not give onsite service in any condition, all services are available on company Premises.
4. WARRANTY & LIABILITY:
4.1 The WaterPay Pro Model comes with a 12-month limited warranty against manufacturing defects, valid from the delivery date.
4.2 The warranty does NOT cover:
Please Note there will be no warranty for coin acceptor in any condition.Water damage, burns, and intentional damage are not acceptable.
Damage due to misuse, unauthorized modifications, improper installation, or external factors like power surges.
Damage caused by the Customer or third-party technicians.
4.3 Warranty claims must be submitted via email or the Company’s service portal with proof of purchase.
4.4 The Company is not liable for any indirect, consequential, or incidental damages from product usage.
4.5 During the warranty period or after its expiration, if any hardware or software updates are required to ensure the smooth functioning of the machine, the
Customer will be responsible for all related charges, including transportation costs.
4.6 Warranty period is 12 months from the date of the Invoice.
(Please Note there will be no warranty for coin acceptor in any condition)
5. REFUNDS & CANCELLATIONS:
5.1 No refunds will be processed once the machine has been dispatched, except in cases of manufacturing defects.
5.2 The Auto-Refund Feature within the WaterPay Pro model applies only in cases of failed water dispensing due to machine errors.
5.3 Cancellation of orders before dispatch may occur processing fee of 5% of the order value.
6. SERVICE & MAINTENANCE:
6.1 The Company remotely troubleshoots software-related issues via call or app-based support.
6.2 For hardware repairs, the Customer must send the faulty part to the Company’s service center, and replacement costs will be borne by the Customer if out of
warranty.
6.3 The Company does not provide on-site servicing unless agreed in a separate maintenance contract.
6.4 The Customer is responsible for the regular cleaning and maintenance of the product.
7. OWNERSHIP & INTELLECTUAL PROPERTY:
7.1 The WaterPay Pro machine remains the property of the Customer upon full payment.
7.2 The software and app-based functionalities of WaterPay Pro remain the exclusive intellectual property of the Company and are licensed to the Customer for use.
7.3 Any tampering, modification, or reverse-engineering of the software is strictly prohibited and may lead to legal action.
8. LIMITATION OF LIABILITY:
8.1 The Company’s liability in any case shall not exceed the total amount paid by the Customer for the product.
8.2 The Company is not responsible for business losses, revenue loss, or damages resulting from machine malfunctions or improper use.
9. NETWORK PROVIDER & UPI CHARGES:
9.1 If UPI, NPCI, PhonePe, or any network providers (e.g., Idea, Vodafone, Airtel, BSNL) update their rules or introduce new charges affecting transactions, such
charges will apply to the customer.
9.2 Any server charges or transaction fees introduced by company ,UPI,NPCI, or PhonePe will be borne by the Customer and not by the Company.
10. IOT SIM CARD USAGE POLICY:
10.1 The Company provides an IoT SIM card with the machine to ensure its smooth operation.
10.2 If the IoT SIM does not work at the Customer’s location, the Customer must purchase another SIM from a compatible provider such as Airtel, Idea, or BSNL (Jio
is not supported). All costs associated with purchasing and setting up the new SIM will be borne by the Customer.
10.3 The IoT SIM remains the property of the Company, which reserves the full rights to activate or deactivate the SIM at its discretion.
10.4 Any misuse of the IoT SIM card is legally actionable, and the Company reserves the right to take appropriate legal action.
11. DISPUTE RESOLUTION & JURISDICTION:
11.1 Any disputes arising from this Agreement shall first be attempted to be resolved amicably through mediation.
11.2 If mediation fails, disputes shall be settled in the jurisdiction of Pune, Maharashtra, as per Indian legal proceedings.
12. GENERAL CONDITIONS:
12.1 The Company reserves the right to update or modify these Terms & Conditions at any time.
12.2 The Customer acknowledges having read, understood and agreed to these Terms before purchase.
12.3 Any additional terms requested by the Customer must be agreed upon in writing by the Company.
